Oakley’s “Win a MotoGP^TM VIP Experience” Lucky Draw 2024” Lucky Draw Terms & Conditions (Malaysia)

1. General 

1. The Oakley “Win a MotoGP^TM VIP Experience” Lucky Draw 2024 (“Contest”, “Lucky Draw”) is organised by EssilorLuxottica Malaysia Sdn Bhd., registration no. 36673-P / 197701005635 (the “Organiser”).

2. The Contest shall commence from 1 September 2024 – 15 October 2024 (“Contest Period”). The Organiser shall reserve the right to revise the Contest Period at any time without prior notice or assign any reason whatsoever. All submissions received after the Contest Period shall be null and void without further notice. The Contest Period and all other terms and conditions are subject to change by the Organiser without prior notice. 

3. The Contest is subject to the Terms and Conditions stated herein and the Organiser reserves the right to vary, add, modify and / or alter these Terms and Conditions as and when it deems fit. Such variations may be communicated through modes of communication deemed suitable by the Organiser.

4. By participating in the Contest, the participant acknowledges and declares that he / she is: 

1. 1. deemed to have read, understood, agreed and accepted the Terms and Conditions herein and agrees to be bound by the same;

   2. fully aware of the risks or liabilities which may be associated with the Contest; 

   3. agreeable that the Organiser and its related and/or associated companies shall not be liable to the participant and/or any other party in any manner whatsoever for any form of liabilities, losses, claims and/or damages howsoever arising in connection with the Contest or otherwise; and 

   4. agreeable that the Organiser’s decisions on all matters relating to the Contest is final, absolute and binding. For avoidance of doubt, no appeals, negotiations, bargaining, correspondence or claims disputing the Organiser’s decision for any reason whatsoever will be entertained.

5. The Organiser reserves the right to amend the Terms and Conditions of this contest without prior notice.

6. These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia. 

2. Eligibility

1. The Contest is open to all individual customers who satisfy the following conditions: 

1. 1. is a legal resident of Malaysia aged 18 years and above as the start of the Contest date, or a holder of a Malaysian Identification Card or expatriates holding a valid working pass in Malaysia at the time of participation, and

1. 1. purchased any Oakley eyewear product(s) in person at physical participating Oakley stores and Sunglass Hut outlets in Malaysia, namely: Oakley Store Sky Avenue, Oakley Store Kuala Lumpur City Centre (KLCC), Oakley Store Lalaport Bukit Bintang City Centre and Oakley Store The Exchange TRX, Sunglass Hut Parkson Pavillion, Sunglass Hut Johor Premium Outlet, Sunglass Hut Penang Landside Airport, Sunglass Hut KLCC Suria, Sunglass Hut KLIA Main Terminal, Sunglass Hut Genting Premium Outlet, Sunglass Hut KLIA Satellite Airport, Sunglass Hut Kota Kinabalu Airport and Sunglass Hut TRX (collectively known as the “Participating Stores”). 

2. The following group of persons shall not be eligible to participate in the Contest:

   1. Employers and Employees of participating Oakley Certified Retailers, Sunglass Hut Stores, Oakley O-Concept Stores, and Employees of the Organiser and their immediate family members (i.e., children, parents, brothers  and sisters, including spouses); and/or

   2. Representatives, agents of advertising and/or service providers of the Organiser (including its affiliated and related companies), and their immediate family members (i.e., children, parents, brothers and sisters, including spouses).

3. Participation Instructions

1. A valid entry requires submission of purchase receipt on: http://my.oakley.com/MotoGP2024 (the “Website”). Repeated entires with receipts evidencing the same purchase are prohibited and will be considered as one submission ONLY. In such instances, the Organiser retains the discretion to disqualify the individual making such repeated entries. 

2. Each participant may submit an entry with every purchase receipt that evidences a purchase of any Oakley eyewear product at any Participating Store during the Contest Period. Subject to the forementioned requirements and the eligibility conditions set out under Paragraph B, participants may submit multiple entries for separate and distinct purchases of Oakley eyewear Product for the Contest during the Contest Period.

3. Any errors made in the submission of the Lucky Draw Participation Form (available at Participating Stores only) (“Form”) must be corrected by contacting Nicole Wong (nicole.wong@sg.luxottica.com). While the Organisor endeavours to review and address such rectification requests in a timely manner, such rectification is not guaranteed and remains subject to the Organiser’s discretion and operational limitations. The Organiser shall not be held responsible in any manner or form for any errors made by the participant in the Form, which may void the participant’s entry into this Contest. 

4. The Organiser may at its sole and absolute discretion, disqualify any participants and/or revoke the submission of the registration Form online at any time, where: 

1. 1. the participant fails to comply with the Terms & Conditions stated herein (including the modification and revision of the Terms & Conditions by the Organiser from time to time); 

   2. the participant attempts to undermine the operation and administration of the Contest by fraud, cheating or deception (including but not limited to attempts to use fake receipts, amended old receipts and participating with the same receipt with different customer names). 

   3. the participant fails to provide accurate, complete, valid, identifiable and/or truthful information during participation, and/or registration to participate at any stage of the Contest. 

5. The participant shall not engage in conduct that directly or indirectly positions the Organiser in a state of disrepute. 

6. The Organiser may at its sole and absolute discretion prohibit participation by any participant who in any manner whatsoever disrupts, tampers and/or engages in improper conduct that affects the Contest or the administration of the Contest and/or breaches any of the Terms and Conditions stipulated herein.

7. In the event this Contest cannot be administered and/or is abandoned and/or cancelled and/or discontinued due to any reason, the Organiser, without being subject to any form of liability and at its sole and absolute discretion, may decide to cancel, terminate, modify, or suspend the Contest and/or invalidate any entries for this Contest without assigning any reasons thereto and without notice to the participants.

4. Lucky Draw Date and Notification

1. The Lucky Draw shall comprise of one lucky draw with the following qualifying and draw dates: 

1. 1. Lucky Draw Qualifying Dates: 1 September 2024 to 15 October 2024;

1. 1. Draw Date: 16 October 2024

2. Contest Winners will be announced via the Website by 21 October 2024 

3. Prize winners will also be notified via electronic mail, short messaging and/or WhatsApp. 

4. If winners cannot be contacted and/or does not acknowledge the above notification within 3 working days, such winners will be deemed to have forfeited the prize unconditionally and unequivocally. In such instances, alternative winner will be selected by random drawing from the remaining eligible entries.

5. Prizes

1. The Organiser will select up to ten (10) winners for the Lucky Draw and each winner will receive one of the following prizes (to be allocated and/or decided at random by the Organiser):

   1. Four (4) MotoGP^TM VIP Experience tickets to the Malaysia Grand Prix;  

   2. One (1) Oakley Arai Helmet autographed by Maverick Vinales: 

   3. Five (5) closed-door meet-and-greet experience with Maverick Vinales at the Oakley store in The Exchange TRX, (the “Meet-and-Greet”). The specific details (e.g. date and time) of the Meet-and-Greet will be made known to the winners at a later date. 

2. Each participant may only win one (1) prize during the Contest Period. 

3. Prizes are strictly non-transferable nor exchangeable for cash or part thereof. Prizes are awarded "as is", without warranty or guarantee, including but not limited to the size or fit of the Oakley Arai Helmet. 

4. In the event the Contest is cancelled, postponed and/or abandoned for any reason, the Organiser without being subject to any form of liability and at its sole and absolute discretion may or may not choose to substitute the Prize with other item(s) of an equal or similar value with or without conditions. In such an event, the Organiser shall not be liable and/or responsible in any manner whatsoever for any form of claim and/or liability howsoever arising, whether direct, indirect, or otherwise. 

5. The Organiser makes no guarantee, warranties or representation with respect to the Prizes and shall not be responsible nor liable for any irregularities, issues and/or damages thereto or arising therefrom. 

6. Prize Collection

1. Winners must produce proof of identity e.g. Identification Card and/or email confirmation upon prize collection or any alternative means of identification as notified by the Organiser’s agent. The Organiser reserves the right to withhold any prizes or request for additional personal identification, if the Organiser has any reason to suspect or doubt the identity of the alleged winner. 

2. Prizes must be self-collected by the winner in person by attending the prize presentation that will be held during the Meet-and-Greet event at TRX. The specific details (e.g. date and time) of the Meet-and-Greet will be made known to the winners at a later date. Should the participant be unable to attend the Meet-and-Greet, the participant will be deemed as having forfeited the prize and the Organiser reserves the right to reselect another winner. 

3. All costs incurred by participants in relation to the contest including but not limited to all transport costs, communication charges, or other related costs shall solely be borne by participants. 

7. Data Privacy Agreement

1. By participating in this Lucky Draw and submitting his/her personal data online or otherwise during the Contest period, each participant hereby acknowledges, consents and permits fully for: 

   1. His/her personal data (including email address and phone number) to be collected, used, processed or disclosed for purposes in relation to the administration of the Contest, including but not limited to providing participants with up-to-date information on the Contest and notifying participants on the outcome of the Lucky Draw; 

   2. His/her personal data to be processed, stored by the Organiser and disclosed, transferred to affiliates and/or third party whether inside or outside of Malaysia including but not limited to the Organiser’s related and/or associated companies, service providers, contractors, business or collaboration partners in accordance with the applicable data protection laws (including the Personal Data Protection Act 2010 of Malaysia); 

   3. The Organiser and its related and/or associated companies to use, publish, exhibit and display including but not limited to participant’s name, the last four digits of their Identification Card Number, image (if any) and comments in any nature or form for documentation, advertising, promotional purpose or any other purpose in any form of media and in any reasonable manner the Organiser sees fit within or outside Malaysia without any form of compensation to the participant. The participant shall hereby waive any rights to claim legal, proprietary and/or beneficiary right thereto; and 

   4. The Organiser reserves the right to disclose and/or divulge the participant’s personal data in the event the Organiser believes that such disclosure is necessary to identify, contact or bring legal action against an individual who might cause or may be causing damage to or interfere (whether intentionally or otherwise) with the Contest and/or the Organiser and its related and/or associated companies and/or any other third party’s rights or property which could be harmed by such activities. The Organiser may also disclose the personal data of the participant if required to do so by a court of law or other relevant bodies.
